1. Eligibility and Capacity to Contract

You must be at least 18 years old and capable of entering into a legally binding agreement under applicable law to rent or use services from Vegas Mobility Solutions.

By proceeding with any booking, you confirm that all details provided are accurate, complete, and truthful to the best of your knowledge.

You acknowledge that it is your responsibility to ensure you or the intended user meets the physical and legal requirements to operate the selected equipment.

2. Equipment Overview and Scope of Services

Vegas Mobility Solutions offers a wide range of mobility and durable medical equipment (DME), including but not limited to: electric mobility scooters (3- and 4-wheel models), power chairs, electric wheelchairs, heavy-duty bariatric chairs, manual wheelchairs, transport chairs, walkers, rollators, knee scooters, lift recliners, and hospital-style adjustable beds.

All equipment is subject to availability and condition. Specific model requests are not guaranteed unless reserved in writing.

Each piece of equipment is tested, sanitized, and quality-checked prior to delivery. Customer is expected to conduct a final check and report any malfunctions or damage upon receipt.

3. Use and Restrictions

You agree to use the rented equipment only for its intended purpose and according to manufacturer specifications and instructions provided by Vegas Mobility Solutions personnel.

Equipment must not be operated in high-traffic roadways, on escalators, stairs, or in other unsafe environments. Use in casinos, hotels, or sidewalks is permitted where allowed by local ordinance and venue policies.

Customers may not allow unauthorized individuals to operate or tamper with equipment. Doing so constitutes a breach of this agreement and may result in immediate service termination and liability for damages.

Intentional misuse or neglect that results in damage or injury will be treated as gross negligence and may result in legal action or reporting to authorities.

4. Payments, Security Deposits, and Charges

Payment is due in full at the time of booking unless otherwise authorized in writing. We accept major debit/credit cards and other payment methods as listed on our website.

Certain rentals may require a refundable security deposit which will be authorized at the time of payment. Deposits are released within 3–5 business days after equipment is returned in satisfactory condition.

Additional charges may apply for special accommodations, extended hours, or off-strip locations. All fees will be transparently disclosed prior to confirmation.

Customers are responsible for any fees incurred from tolls, parking violations, or other expenses related to improper use of rented equipment.

5. Reservation Modifications, Cancellations, and Refunds

Reservations can be modified up to 24 hours prior to scheduled delivery, subject to availability.

Cancellations made at least 24 hours before delivery are eligible for a full refund. Cancellations made within 24 hours of delivery are subject to a 25% cancellation fee.

No refunds will be issued once equipment is delivered and accepted by the customer, even if the rental is unused.

Refunds will be issued using the original payment method and may take up to 7 business days depending on the bank or processor.

6. Delivery, Pickup, and Missed Appointments

We offer scheduled delivery and pickup services throughout Las Vegas and surrounding areas. Delivery time windows will be confirmed at the time of booking.

Customers must be present and responsive at the scheduled location and time. Missed appointments may result in a non-refundable rescheduling fee.

If delivery is made to a hotel or concierge desk, the customer is responsible for collecting the equipment in a timely manner and confirming receipt. We are not responsible for equipment that goes missing after successful hotel hand-off unless documented otherwise.

Equipment must be returned in the same location and condition as delivered, unless alternative arrangements are made in writing.

7. Responsibility for Damage, Loss, and Theft

Customers accept full responsibility for the equipment during the rental period. This includes responsibility for damages caused by misuse, accidents, or environmental exposure (e.g., water damage, overheating, etc.).

Lost or stolen equipment must be reported to Vegas Mobility Solutions immediately and a police report must be filed within 24 hours. The customer is liable for the full replacement cost of the equipment.

Any required repairs due to customer negligence will be billed to the customer, and the total will be due within 7 days of invoice.

Normal wear and tear is acceptable; however, excessive grime, staining, or other unsanitary returns may result in a cleaning fee.

8. Limitation of Liability and Indemnification

Vegas Mobility Solutions is not liable for any injury, death, loss, or damage resulting from use or misuse of equipment.

You agree to indemnify and hold harmless Vegas Mobility Solutions, its employees, contractors, and affiliates against any claim, damage, liability, or cost arising from your use of the equipment or violation of these terms.

This limitation of liability applies to all damages of any kind, including direct, indirect, punitive, incidental, and consequential damages.

Nothing in this agreement shall limit liability in the event of gross negligence or willful misconduct by Vegas Mobility Solutions.

9. Communication Policy and SMS Consent

By providing your mobile number at the time of booking, you consent to receive SMS/text messages from Vegas Mobility Solutions for purposes including but not limited to:

- Confirming your booking and delivery details

- Providing delivery status updates and driver arrival times

- Sharing important rental notices or return reminders

- Offering promotions or satisfaction surveys (no more than 4 promotional messages per month)

You may opt out of promotional messages at any time by replying “STOP.” Transactional messages are required for service coordination and may not be opted out of without canceling your order.

Your number will not be sold, rented, or shared with any third party without your explicit consent. All communications are logged for quality assurance and training purposes.

10. Data Privacy and Customer Information

Your personal data, including your name, address, phone number, payment information, and rental history, is stored securely and is used solely for the purpose of processing your order and enhancing your customer experience.

Vegas Mobility Solutions uses encrypted systems and secure gateways for all payments and communications.

We do not sell or share your data with unaffiliated third parties. You may request to review, update, or delete your stored data at any time by contacting Support@VegasMobilitySolutions.com.

11. Termination, Suspension, and Denial of Service

Vegas Mobility Solutions reserves the right to refuse or cancel service at any time for reasons including but not limited to:

- Repeated booking cancellations or payment issues

- Verbal or physical abuse toward our staff

- Unsafe or illegal operation of equipment

- Falsification of identity or misuse of customer information

Early termination of a rental contract due to misuse may result in equipment repossession and additional fees. Legal action may be pursued in cases of fraud or endangerment.

12. Governing Law and Legal Proceedings

These Terms and Conditions are governed by the laws of the State of Nevada.

Any disputes or legal actions arising from this agreement must be filed exclusively in the appropriate state or federal court located in Clark County, Nevada.

In the event of legal action, the prevailing party shall be entitled to reasonable attorney's fees and court costs.

Both parties agree to attempt resolution through good-faith mediation prior to initiating court proceedings.

13. Acceptance and Final Acknowledgment

By completing a reservation, making payment, or using any equipment or service from Vegas Mobility Solutions, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

You acknowledge that your use of the equipment is voluntary and at your own risk.

You agree that a digital acceptance of these terms (checkbox, text confirmation, or email agreement) holds the same legal weight as a signed physical contract.
